3. PRODUCT ACCURACY AND LEGAL METROLOGY
• Mandatory Declarations: In compliance with the Legal Metrology (Packaged Commodities) Rules, 2011, we explicitly display the Country of Origin, net quantity, and dimension details on every product page.
• Color Disclaimer: We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor's display of any color will be accurate.
• Fair Pricing: We do not manipulate prices to gain unreasonable profit. Prices are determined based on market conditions, input costs, and business necessity, in compliance with the Consumer Protection (E-Commerce) Rules, 2020.
4. MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.
5. BILLING AND ACCOUNT ACCURACY
• Order Limits: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
• Accurate Data: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers, so that we can complete your transactions.
6. RETURNS, REFUNDS, AND CANCELLATIONS
• Defective Goods: We will accept returns and provide a full refund or replacement for any product that is defective, deficient, spurious, or not as described.
• Cancellation Policy:
– By User: You may cancel your order before it has been dispatched. Once dispatched, the order is subject to our Return Policy.
– By Us: We reserve the right to cancel orders due to stock unavailability or suspicion of fraud. If we cancel your order, a full refund will be processed immediately.
• Cancellation Charges: We do not impose unjustified cancellation charges. However, if a cancellation occurs after significant shipping costs have been incurred by us due to user error, we reserve the right to deduct reasonable logistics costs from the refund.
• Refund Timeline: Approved refunds will be processed to the original method of payment within 7-10 business days, or as prescribed by applicable RBI banking norms.

• Timeline: Delivery times are estimates and start from the date of shipping, rather than the date of order.
• Delays: We are not responsible for delays caused by the courier service or events beyond our control (Force Majeure).
• Risk of Loss: All items purchased from The No Name Club are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

The No Name Club is powered by Shopify Inc., which provides the online e-commerce platform that allows us to sell our products and services to you.
• Limitation: While Shopify powers the platform, all purchases, contracts, and transactions are made directly between you and The No Name Club.
• Release: By using the Services, you acknowledge and agree that Shopify is a third-party service provider and is not responsible for any aspect of your purchase, including product quality, delivery, or any injury/damage resulting from purchased products. You hereby release Shopify and its affiliates from all claims, damages, and liabilities arising from your transactions with The No Name Club.
10. DATA PROCESSING BY SHOPIFY
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
• Data Storage: Your data is stored through Shopify's data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall.
• Cross-Border Transfer: Information you submit may be transferred to and processed by Shopify in Canada, the United States, and other countries to provide these Services. • Service Basis: We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free.
• Limitation: In no case shall The No Name Club, our directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.
• Cap: Our liability shall be limited to the maximum extent permitted by law, and in no event shall exceed the total amount paid by you for the specific product giving rise to the claim.
You agree to indemnify, defend and hold harmless The No Name Club and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Response Timeline: We acknowledge all complaints within 48 hours and aim to resolve them within one (1) month from the date of receipt.
17. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms of Service shall be governed by and construed in accordance with the laws of India.
• Amicable Resolution: In the event of any dispute, the parties shall first attempt to resolve the matter amicably within 30 days.
• Arbitration: If unresolved, the dispute shall be referred to a Sole Arbitrator to be appointed by mutual consent of the parties. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Ahmedabad, Gujarat.
• Jurisdiction: Subject to the arbitration clause, the courts at Ahmedabad, Gujarat shall have exclusive jurisdiction.
We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including "line-noise" interference), acts of God, widespread disease or pandemic, war, terrorism, riots, embargoes, or acts of civil or military authorities.
